1. Agreement to these Terms
By accessing or using the https://longstoryshort.wine/ website ("Website"), placing an order with or otherwise dealing with Long Story Short ("Long Story Short", "We" or "Us"), you agree to be bound by these Terms and Conditions ("Terms").
Please read these Terms carefully. If you do not agree with any part of them, please do not use Our Website or place an order with Us.
We reserve the right to amend these Terms at any time. The current version will always be published on Our Website. Continued use of Our Website or services after any changes are published constitutes your acceptance of the updated Terms.

- "Order" means any order for goods or services placed with Us through any channel.
- "Goods" means wine, spirits, merchandise or any other products offered for sale by Long Story Short.

The content on Our Website is for general information only and is subject to change without notice. While We make every effort to ensure accuracy, We do not warrant that content is complete, current or free from errors. Any reliance you place on information from Our Website is at your own risk.
Long Story Short is not liable for any loss or damage — including indirect or consequential loss — arising out of your use of, or inability to use, the Website or any content published on it. This does not affect any liability We may have that cannot be excluded under the Australian Consumer Law.
We reserve the right to withdraw or amend any information, offers or services on the Website without notice.
4. Legal Age Requirements
Under Australian law, you must be 18 years of age or older to purchase, order or receive alcoholic beverages. It is an offence to sell or supply liquor to a person under 18 years of age.
By placing an order you warrant that:
- you are 18 years of age or older and will produce evidence of age (in the form of a driver's licence, passport, or proof of age card) upon request at the time of delivery;
- any person for whom you are obtaining the Goods, or to whom you will supply the goods, is 18 years of age or older; and
- you will not take or supply any part of your order to any liquor-restricted area or community.
Products purchased from Long Story Short are for personal consumption only and are not for resale.
5. Responsible Service of Alcohol
We are committed to promoting the responsible consumption of alcohol. We encourage all customers to enjoy Our Goods in moderation and to be aware of the potential risks associated with excessive alcohol consumption. If you or someone you know is struggling with alcohol-related issues, We urge you to seek help from professional services.
6. Terms of Sale
By placing an Order with Us you are making an offer to purchase goods on the following terms:
- All Orders are subject to availability and confirmation of the order price.
- When placing an Order you warrant that all details provided are true and correct.
- Long Story Short reserves the right to refuse any Order at its sole discretion.
- A contract for the sale of goods is not formed until your payment has been processed and accepted by Us.
- When your Order is received, you will be sent an acknowledgement email. This is not an acceptance of your order.
- We endeavour to ensure all product descriptions, vintages and prices are accurate. If We discover an error in any Order, We will contact you as soon as practicable and give you the option to confirm the Order at the correct price or cancel it. If We cannot contact you, We may cancel the order and refund any payment received.
- Long Story Short reserves the right to correct any errors, inaccuracies or omissions and to update information at any time without notice.
7. Pricing and Payment
All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable. Delivery charges are additional and will be shown at checkout.
We take your privacy seriously and are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth). When you place an order on Our website, We collect and store your personal details, including your name, address, and payment information, to process your order. We do not share your information with third parties except as required by law or to fulfill your order.

8. Cancellations
If you need to change or cancel an Order, please contact Us as soon as possible via email at jessi@roseandvine.com.au. We will do Our best to accommodate your request, but cannot guarantee changes can be made once an Order has been placed.
We may cancel your Order before delivery in whole or in part if:
- any Goods are not available;
- there was an error in the description or price of any Goods; or
- your Order is in breach of these Terms or any applicable law.
If We cancel your Order after payment has been received, We will refund you in full.
9. Returns and Refunds
Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure.
Subject to clause 8, We do not offer refunds or exchanges for change of mind.
Wine will be replaced if it is damaged in transit or if incorrect wine has been shipped. To arrange a replacement or refund, please contact Us via email at jessi@roseandvine.com.au, providing your Order number and a description of the issue. Please retain all packaging materials relating to any damaged goods.
Any implied conditions or warranties are excluded to the maximum extent permitted by law, subject to your non-excludable rights under the Australian Consumer Law.
10. Delivery
We deliver Our Goods Australia-wide. Delivery times and costs vary by region.
Delivery times are estimates based on carrier schedules and do not include weekends, public holidays or unforeseen circumstances. We cannot guarantee delivery times. For enquiries about your Order, contact Us via email at jessi@roseandvine.com.au.
Deliveries will only be made during lawful hours in accordance with the conditions of Our Liquor Licence.
If you fail to take delivery of Goods you have ordered, We reserve the right to charge any expenses incurred as a result.
Delivery will not be made to persons who are under 18, appear intoxicated, or who cannot produce satisfactory evidence of age when requested. We reserve the right to refuse delivery in these circumstances.
11. Weather and Heat Policy
Wine is a perishable commodity that is sensitive to extreme temperatures. During periods of hot or cold weather, We reserve the right to delay shipment of Orders to protect wine quality.
Once wine leaves Our premises, Long Story Short is not responsible for damage caused by extreme weather conditions during transit. Risk of loss or damage passes to you upon dispatch of your Order.
Please ensure your delivery address has a suitable, shaded or cool location for wine to be left if you are not available to receive it.
12. Intellectual Property and Copyright
All content on Our Website — including but not limited to text, images, graphics, logos, design and layout — is owned by or licensed to Long Story Short and is protected by Australian and international copyright law. All rights are reserved.
You may not reproduce, copy, distribute, sell or otherwise exploit any content from Our Website without Our prior written consent. You may not use any content in connection with any commercial enterprise.
13. Links to Other Websites
Our Website may contain links to third-party websites for your convenience. These links do not constitute an endorsement of those sites. We have no control over and accept no responsibility for the content, privacy practices or availability of linked sites.
You may link to Our Website provided you do so in a lawful way that does not damage Our reputation or suggest any association or endorsement by Us where none exists. We reserve the right to withdraw linking permission without notice.

Without limiting your non-excludable rights under the Australian Consumer Law, to the fullest extent permitted by law:

- content on Our Website does not constitute advice and should not be relied upon when making any decision;
- Long Story Short excludes all implied conditions, warranties and terms to the fullest extent permitted by law; and

Nothing in these Terms excludes or limits Our liability for any liability that cannot be excluded at law.

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising under or in connection with these Terms.
17. Severability
If any provision of these Terms is found to be illegal, invalid or unenforceable, that provision will be read down or severed to the extent necessary without affecting the remaining provisions, which will continue in full force and effect.
18. Waiver
Failure by Long Story Short to enforce any provision of these Terms does not constitute a waiver of Our rights. Any waiver must be in writing and signed by an authorised representative of Long Story Short to be effective.
19. Entire Agreement
These Terms, together with Our Privacy Policy, constitute the entire agreement between you and Long Story Short with respect to your use of Our Website and the purchase of Our Goods. All prior discussions, representations and agreements are superseded.
